The Office of the U.S. Trade Representative (“USTR”) has announced that it is extending certain expiring China 301 tariff exclusions and is designating certain additional such exclusions. The USTR is taking these actions with respect to certain medical-care products to reflect the rising spread and ongoing efforts to combat COVID-19. In some instances, existing exclusions are being extended. In other instances, additional exclusions are being put into place in response to comments filed in connection with a March 25, 2020 request for comments as to additional medical care items that should be considered for exclusion. In both cases, the effective period will be from January 1, 2021 through March 31, 2021.
These actions are being implemented by establishing new HTS Chapter 99 China 301 provisions and Chapter 99 Subchapter III U.S. Notes as described in four Annexes described below. The Annexes do not distinguish between existing and new exclusions. However, a table at the end of the notice identifies the newly excluded items (see below).
