Request for Circumvention Inquiries on Circular Welded Pipe and Tube Completed in Vietnam Using Hot-Rolled Steel Manufactured in China, Korea, and Taiwan

Case Summary

I.  Type of Action: Request for country-wide circumvention inquiries to determine whether circular welded non-alloy steel pipe and certain circular welded carbon steel pipes and tubes (collectively, CWP) completed in Vietnam using hot-rolled steel manufactured in China, Korea, and Taiwan are circumventing the antidumping duty (ADD) orders on CWP from China, Korea, and Taiwan, and the countervailing duty (CVD) order on CWP from China.

II.  Product: CWP from China, Korea, and Taiwan is subject to different ADD/CVD order scopes.

  • China (ADD/CVD): Welded carbon-quality steel pipes and tube, of circular cross-section, with an outside diameter not more than nominal 16 inches (406.4 mm), regardless of wall thickness, surface finish (e.g., black, galvanized, or painted), end finish (plain end, beveled end, grooved, threaded, or threaded and coupled), or industry specification (e.g., American Society for Testing and Materials International (ASTM), proprietary, or other), generally known as standard pipe, fence pipe and tube, sprinkler pipe, and structural pipe (although subject product may also be referred to as mechanical tubing).
  • Korea (ADD): Circular welded non-alloy steel pipe and tube, of circular cross-section, not more than 406.4 millimeters (16 inches) in outside diameter, regardless of wall thickness, surface finish (black, galvanized, or painted), or end finish (plain end, beveled end, threaded, or threaded and coupled). These pipes and tubes are generally known as standard pipes and tubes and are intended for the low-pressure conveyance of water, steam, natural gas, air, and other liquids and gases in plumbing and heating systems, air-conditioning units, automatic sprinkler systems, and other related Standard pipe may also be used for light load-bearing applications, such as for fence tubing, and as structural pipe tubing used for framing and as support members for reconstruction or load-bearing purposes in the construction, shipbuilding, trucking, farm equipment, and other related industries. Unfinished conduit pipe is also included in the order.
  • Taiwan (ADD): Welded carbon steel pipes and tubes, of circular cross section, with walls not thinner than 0.065 inch, and 0.375 inch or more but not over 4.5 inches in outside diameter.
  • Taiwan (ADD): (1) Circular welded non-alloy steel pipes and tubes of circular cross section over 4.5 inches, but not over 16 inches in outside diameter, with a wall thickness of 0.065 inches or more, regardless of surface finish (black, galvanized, or painted), or end-finish (plain end, beveled end, threaded, or threaded and coupled); and (2) Circular welded non-alloy steel pipes and tubes, of circular cross-section less than 16 inches, with a wall thickness of less than 0.065 inches, regardless of surface finish (black, galvanized, or painted) or end-finish (plain end, beveled end, threaded, or threaded and coupled). These pipes and tubes are generally known as standard pipes and tubes and are intended for the low pressure conveyance of water, steam, natural gas, air, and other liquids and gases in plumbing and heating systems, air conditioning units, automatic sprinkling systems, and other related uses, and generally meet ASTM A-53 specifications. Standard pipe may also be used for light load-bearing applications, such as for fence tubing and as structural pipe tubing used for framing and support members for construction, or load-bearing purposes in the construction, shipbuilding, trucking, farm-equipment, and related industries. Unfinished conduit pipe is also included in this order.

III.  HTSUS Classifications: CWP from China, Korea, and Taiwan is subject to different ADD/CVD order scopes.

  • China (ADD/CVD): CWP is currently imported under: 7306.30.1000, 7306.30.5025, 7306.30.5032, 7306.30.5040, 7306.30.5055, 7306.30.5085, and 7306.30.5090. CWP might also be imported under 7306.19.1010, 7306.19.1050, 7306.19.5110, 7306.19.5150, 7306.50.1000, 7306.50.5050, and 7306.50.5070.
  • Korea (ADD): 7306.30.10.00, 7306.30.50.25, 7306.30.50.32, 7306.30.50.40, 7306.30.50.55, 7306.30.50.85, and 7306.30.50.90.
  • Taiwan (ADD): 7306.19.1050, 7306.19.5110, 7306.19.5150, 7306.50.1000, 7306.50.5050, and 7306.50.5070.
  • Taiwan (ADD): 7306.30.5025, 7306.30.5032, 7306.30.5040, and 7306.30.5055.

IV.  Date of Filing: May 17, 2022.

V.  Requestors: Bull Moose Tube Company, Maruichi American Corporation, Nucor Tubular Products Inc., Wheatland Tube Company, and the United Steel, Paper and Forestry, Rubber, Manufacturing, Energy, Allied Industrial and Service Workers International Union, AFL-CIO, CLC.
